EVERWILD TRAVEL CO.
At EverWild Travel Co., our goal is to help you create meaningful travel experiences with confidence and ease. To ensure a clear understanding of our services and responsibilities, please carefully review the following Terms & Conditions. By authorizing EverWild Travel Co. to provide travel planning or booking services, submitting payment, or participating in travel arrangements booked through EverWild Travel Co., you acknowledge and agree to these terms.
1. Independent Agency Disclosure
EverWild Travel Co. acts solely as an independent travel advisor and booking intermediary. EverWild Travel Co. does not own, operate, manage, control, or otherwise provide the travel services offered by airlines, cruise lines, hotels, resorts, vacation package providers, theme parks, transportation companies, tour operators, excursion providers, or any other third-party travel suppliers.
All travel services are provided by independent third-party suppliers. EverWild Travel Co. acts only as an agent for these suppliers in arranging travel services on behalf of clients.
Because EverWild Travel Co. does not control the operations of these suppliers, EverWild Travel Co. assumes no responsibility or liability for any acts, errors, omissions, negligence, personal injury, property damage, financial default, schedule changes, delays, cancellations, overbookings, strikes, labor disputes, weather events, government actions, force majeure events, supplier bankruptcy, or any other occurrence beyond its reasonable control.
2. Third-Party Supplier Responsibility
All reservations are subject to the terms, conditions, and policies of the applicable travel supplier.
EverWild Travel Co. is not responsible for:
Changes to itineraries
Flight schedule changes
Airline cancellations
Hotel overbookings
Cruise itinerary changes
Theme park operational changes
Supplier pricing changes
Excursion cancellations
Transportation delays
Lost, damaged, or delayed baggage
Supplier bankruptcy or financial insolvency
Any acts or omissions of third-party suppliers
Clients acknowledge that any claims arising from services provided by a supplier must be directed to the supplier responsible for providing those services.
3. Client Review of Travel Documents
Clients are responsible for carefully reviewing all itineraries, invoices, reservation confirmations, travel documents, names, dates, destinations, accommodations, and services immediately upon receipt.
Any discrepancies, errors, omissions, or concerns must be reported to EverWild Travel Co. as soon as possible and prior to travel whenever possible.
Failure to review and verify travel documents does not transfer responsibility to EverWild Travel Co. for inaccuracies that were disclosed within documentation provided to the client.
Travel documents serve as the final confirmation of booked services. Clients agree to review all documentation thoroughly before making final payment and prior to departure.
4. Pricing & Availability
Travel pricing and availability are subject to change until deposits are received and reservations are confirmed.
Quotes provided by EverWild Travel Co. are estimates only and are not guaranteed until booked and confirmed by the supplier.
EverWild Travel Co. is not responsible for price increases imposed by suppliers before reservations are secured.
5. Deposits & Final Payments
Clients are responsible for submitting all required deposits and final payments by supplier deadlines.
Failure to make payments by required deadlines may result in:
Cancellation of reservations
Loss of deposits
Supplier-imposed penalties
Additional fees
Reinstatement costs, if permitted by the supplier
EverWild Travel Co. is not responsible for reservations canceled due to missed payment deadlines.
6. Planning Fees
Certain travel planning services may require a non-refundable planning fee.
Planning fees compensate EverWild Travel Co. for professional consultation, itinerary research, supplier coordination, destination expertise, and travel planning services.
Planning fees:
Are non-refundable
Do not guarantee availability
Do not guarantee booking
Are separate from supplier deposits and travel costs
Once planning services have begun, planning fees are considered earned.
7. Cancellations & Refunds
Cancellation penalties are determined solely by the applicable supplier.
Refund eligibility, if any, is subject to supplier policies and procedures.
EverWild Travel Co. does not control supplier cancellation policies and cannot guarantee refunds under any circumstances.
Planning fees remain non-refundable regardless of cancellation.
8. Travel Insurance Recommendation
EverWild Travel Co. strongly recommends the purchase of comprehensive travel insurance.
Travel insurance may provide protection for:
Trip cancellation
Trip interruption
Medical emergencies
Emergency evacuation
Travel delays
Lost baggage
Supplier insolvency
Clients who decline travel insurance acknowledge that they assume all financial risk associated with travel disruptions, cancellations, medical expenses, supplier failures, and unforeseen circumstances.
9. Travel Documentation & Entry Requirements
Clients are solely responsible for obtaining and maintaining all required travel documentation, including but not limited to:
Passports
Visas
Entry permits
Vaccination records
Identification documents
EverWild Travel Co. is not responsible for denied boarding, denied entry, missed travel, fines, penalties, or additional expenses resulting from incomplete, expired, inaccurate, or missing travel documentation.
10. Force Majeure
EverWild Travel Co. shall not be liable for any delay, cancellation, loss, injury, damage, or expense resulting from circumstances beyond its reasonable control, including but not limited to:
Natural disasters
Severe weather
Hurricanes
Wildfires
Floods
Pandemics
Epidemics
Government actions
Civil unrest
Terrorism
Labor disputes
Transportation interruptions
Supplier failures
No refunds, credits, or compensation shall be owed by EverWild Travel Co. for events falling within this provision.
11. Limitation of Liability
To the fullest extent permitted by law, EverWild Travel Co.'s liability shall be limited to the amount of planning fees paid directly to EverWild Travel Co.
Under no circumstances shall EverWild Travel Co. be liable for:
Indirect damages
Consequential damages
Emotional distress
Loss of enjoyment
Lost wages
Lost business opportunities
Additional travel expenses
Supplier failures or negligence
12. Chargebacks & Payment Disputes
Clients agree not to initiate chargebacks for services properly rendered by EverWild Travel Co.
Any billing disputes must first be submitted in writing and allow EverWild Travel Co. a reasonable opportunity to resolve the matter.
Chargebacks initiated for valid planning services may result in collection efforts and recovery of associated costs.
13. Communication
EverWild Travel Co. strives to provide timely communication throughout the planning process. Response times may vary during weekends, holidays, travel periods, or periods of high booking volume.
Clients agree to provide accurate contact information and promptly respond to requests necessary to complete travel arrangements.
14. Electronic Communications
Clients consent to receive invoices, itineraries, confirmations, travel documents, notices, and other communications electronically through email, client portals, or other digital methods.
15. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania.
Any disputes arising from services provided by EverWild Travel Co. shall be resolved in the appropriate courts of Pennsylvania.
16. Acceptance of Terms
By authorizing travel arrangements, paying a planning fee, submitting a deposit, making a final payment, or otherwise engaging the services of EverWild Travel Co., the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
